Myth: Paper-based discovery is still fine.

Reality: All but a fraction of the data created today is in digital format. Printing out material for review, without initial filtering, adds costs, creates a layer of inefficiency in terms of time and quality, and misses critical meta-data.

Legal malpractice issues relating to insufficient discovery will grow in importance (esp. vis-à-vis the revised FRCP) and as more states codify e-discovery procedures.


Myth: Too Expensive.
